Target class action claims canned fruit cocktail falsely labeled as containing 100% fruit juice - Top Class Actions

Target falsely labels its Market Pantry Fruit Cocktail product as classic fruit cocktail in 100% fruit juice because the fruit pieces shown on its packaging are served in a solution that is more than just juice, a new class action lawsuit alleges.

Martin argues that representing the mixed fruit in the Target fruit cocktail as served in 100% fruit juice is false, deceptive and misleading and that the “unexpected ingredients” are only revealed in fine print on the ingredient list on the back of the container. 

“Consumers are misled to expect the mixed fruit would be contained within only 100% fruit juice, instead of water combined with additives of ‘natural flavor (and) ascorbic acid,’” the Target class action states.

Martin wants to represent a Florida class of consumers who purchased the Market Pantry canned fruit cocktail product during the statutes of limitations for each alleged cause of action. 

Martin argues Target misleads consumers who are concerned about the use of chemicals and additives in their foods and beverages, with more than half of Americans believing additives “pose a serious health risk.” 

“Surveys consistently show that consumers view foods made without chemicals or additives as natural and healthier,” the Target class action states. 

Martin claims Target is guilty of fraud and violates the Florida Deceptive and Unfair Trade Practices Act and a Florida statute on false and misleading advertising. 

She demands a jury trial and requests declaratory relief along with an award of monetary damages for herself and all class members. 

A consumer recently filed another class action lawsuit against Wegmans Food Market, arguing it falsely advertises its canned fruit products as containing 100% juice. 

A separate consumer filed a similar complaint against Walmart over claims the retailer falsely advertises that its Great Value mixed fruit cups contain 100% juice.
